HR News Overtime Rule NearsEmployers and others have until September 25 to submit comments to shape the rule governing which workers are eligible for overtime pay. Once the deadline passes, employers will face a waiting game before learning what changes may be in store.

In late July, the U.S. Department of Labor (DOL) announced it was soliciting comments through a Request for Information (RFI) dealing with the long-stalled and much-debated rule aimed at raising the salary threshold in the Fair Labor Standards Act (FLSA) so that more workers will be eligible for overtime pay.

Employment lawyers like new Trump pick to head DOL

President Donald Trump has nominated Alexander Acosta, a former National Labor Relations Board (NLRB) member, to serve as secretary of labor. The announcement came less than 24 hours after Trump’s first choice, Andrew Puzder, withdrew from the approval process.

Acosta, who is currently the dean of the Florida International University College of Law, is well qualified for the position, experts say. He was nominated to the NLRB by President George W. Bush and later served as assistant attorney general for the U.S. Department of Justice’s Civil Rights Division, which means he has a good understanding of how agencies operate, according to David S. Fortney, a founder of Fortney & Scott and an editor of Federal Employment Law Insider.

Employers need to be ready for new overtime rule by December 1

The flurry of speculation is finally over. The White House and the U.S. Department of Labor (DOL) have released the new final rule governing which workers must be paid overtime. The changes aren’t quite as drastic as what employers were preparing for based on the contents of the proposed rule made public last summer, but the final rule more than doubles the amount workers must earn to qualify as exempt from the law’s overtime pay requirement.  3D Man Overtime Clock

The changes mean some 4.2 million more employees across the country, according to White House estimates, will be eligible to earn overtime pay when the new final rule takes effect on December 1.

Job programs, misclassification initiative among DOL budget priorities

The U.S. Department of Labor’s (DOL) new budget request pushes programs to help veterans and the long-term unemployed while continuing priorities from previous years, including efforts to fight misclassification of workers as independent contractors.

The DOL’s fiscal year 2014 budget requests $12.1 billion in discretionary funding—money Acting Labor Secretary Seth D. Harris said will be used for investments to create jobs, upgrade workers’ skills, and “make sure Americans can support their families with a decent wage and secure benefits.”

Solis, Trumka Push for Comprehensive Immigration Reform

Today the U.S. Department of Labor (DOL) hosted a live webcast interview with Labor Secretary Hilda Solis and AFL-CIO President Richard Trumka. During the webcast, both parties made the case for the necessity of comprehensive immigration reform, decrying individual state movements such as the controversial immigration law in Arizona as a means for racial profiling and shifting blame for economic failures onto undocumented workers.

Trumka outlined the AFL-CIO’s proposed five-point approach, which he noted is the first position to receive unanimous support from every member union of the AFL-CIO. The five points are (1) a mechanism to let current undocumented workers gain legal status, (2) an independent commission to monitor labor shortages, preventing immigration from being a way to drive down wages for the rest of the American people, (3) reasonable border enforcement, (4) strict employer compliance, which includes issuance of some form of tamperproof identification, and (5) putting an eventual end to guest-worker programs.
