Paid sick leave laws for Chicago-area workers take effect July 1

Most employers in Chicago and Cook County will be required to offer paid sick leave beginning July 1. The city of Chicago passed a sick leave ordinance last summer, and Cook County (where Chicago is located) passed a nearly identical law in October. The ordinances apply to all businesses that are located in the city or county or are subject to city licensing requirements (except for employers in the construction industry).

The laws require employers, regardless of size, to provide all employees who work at least 80 hours in a 120-day period with one hour of paid sick leave for every 40 hours worked, up to 40 hours of leave per year. Employees are allowed to carry half of their unused accrued paid sick leave (up to 20 hours) to the next year. In addition, employers that are subject to the federal Family and Medical Leave Act (FMLA) must allow FMLA-eligible employees to carry over up to 40 additional hours of accrued paid sick leave to use exclusively for FMLA-qualifying purposes.

Arizona Supreme Court upholds minimum wage, paid leave law

In a three-sentence order entered just before the close of business March 14, the Arizona Supreme Court rejected a constitutional challenge to the Fair Wages and Healthy Families Act, commonly known as Proposition 206. The unanimous ruling dashed the last remaining hope of business groups trying to block the voter initiative, which raised the state’s minimum wage to $10 per hour on January 1 and mandates paid sick leave for most employees beginning July 1, 2017.

More than 58 percent of Arizona voters approved the law on the November 2016 ballot. The Arizona Chamber of Commerce and Industry led the legal challenge to the law, arguing it violated the Revenue Source Rule in the Arizona Constitution, which makes any citizen initiative that requires the expenditure of state funds specify from where the funds will come.

Another New Jersey city requires paid sick time

Morristown has joined the list of New Jersey cities that require employers to provide paid sick time to employees. Employers in Morristown have until January 11 to come into compliance with the city’s paid sick time ordinance, which was passed in September.

Under the ordinance, employers with 10 or more employees in Morristown must provide up to 40 hours of paid sick time, while employers with nine or fewer employees in the city must provide up to 25 hours of paid sick time. In determining the number of employees it has, an employer must count full-time, part-time, and temporary employees.

Time for federal contractors to meet new paid leave requirements

Contractors entering into federal contracts on or after January 1, 2017, must comply with the U.S. Department of Labor’s (DOL) new regulations requiring them to provide workers 56 hours of paid sick leave a year.

The regulations implement President Barack Obama’s Executive Order 13706, which was issued on September 7, 2015. The coverage provisions are the same as those for the $10.10 hourly minimum wage requirements for federal contractors. Employees whose wages are governed by the Davis-Bacon Act, the Service Contract Act, or the Fair Labor Standards Act (FLSA) are also covered.

States with employment-related ballot questions mostly approved them during the November 8 election, and employers have little lead time before many measures will be implemented.

All told, 14 states have new provisions with which companies must comply, some as early as January 1, 2017.

Arizona voters approve increased minimum wage, paid sick leave

On November 8, nearly 60% of Arizona voters cast ballots in favor of increasing the state’s minimum wage and providing mandatory paid sick leave. The measure ensures that employers will have to pay at least $10 per hour beginning January 1, 2017. Thereafter, the minimum wage will increase by 50 cents each year until it reaches $12 per hour in 2020.

Based on unofficial returns, Proposition 206, the Healthy Working Families Initiative, passed by healthy margins in 14 of Arizona’s 15 counties, with only Graham County in the southeast corner of the state voting against it.

New Chicago ordinance will require employers to provide paid sick leave

On June 22, the Chicago City Council passed an ordinance that will require nearly all employers in Chicago to provide paid sick leave to employees. The ordinance, which passed 48-0 despite opposition from business and employer groups, follows the lead of similar laws in several states and more than a dozen cities. It is expected to be signed into law quickly by Mayor Rahm Emanuel, and it will take effect on July 1, 2017.

The ordinance will apply to virtually all employers in Chicago, regardless of the number of employees. All businesses that have a location in the city or are subject to city licensing requirements must comply (except for employers in the construction industry).

Minneapolis employers must prepare for new paid sick leave law

In a unanimous vote, the Minneapolis City Council has passed a paid sick and safe leave ordinance that is scheduled to take effect on July 1, 2017.

The ordinance covers all employers with one or more employees, but employers with fewer than six employees must provide only unpaid sick and safe leave.

Elizabeth is latest New Jersey city to require paid sick leave

Elizabeth will be the 10th New Jersey municipality to require employers to provide paid sick leave when a new law takes effect on March 2.

Elizabeth’s law largely mirrors laws passed in Bloomfield, East Orange, Irvington, Jersey City, Montclair, Newark, Passaic, Paterson, and Trenton.

The Elizabeth law applies to all private employers regardless of size, but the amount of paid sick leave employees are eligible to take varies based on the employer’s total number of employees.

Proposed rule spells out paid sick leave requirements for federal contractors

The U.S. Department of Labor (DOL) has released its proposed regulations implementing President Barack Obama’s Executive Order requiring paid sick leave for employees of federal contractors.

Executive Order 13706, signed on September 7, 2015, will apply to new contracts and replacements for expiring contracts that result from solicitations issued on or after January 1, 2017, or that are awarded outside the solicitation process on or after January 1, 2017.
