New Louisiana law prohibits employers from seeking social media passwords

Louisiana’s new Personal Online Account Privacy Protection Act (House Bill 340) goes into effect August 1. It precludes employers from requesting or requiring employees and job applicants to disclose any username or password that allows access to their personal online accounts.

The law prohibits employers from discharging or disciplining employees or from refusing to hire applicants who won’t divulge their personal information. The law allows employers to request or require employees to disclose usernames or passwords to gain access to or operate electronic communication devices paid for or supplied in whole or in part by the company or to gain access to or operate any account or service provided by the employer or used for its business purposes.

Louisiana’s scaled-down pay law goes into effect August 1

Louisiana’s Equal Pay for Women Act (EPWA), which applies only to public-sector employers, goes into effect August 1. The new law affirms that paying unequal wages to public employees on the basis of sex is discriminatory and violates public policy.

The original bill would have covered both public- and private-sector employees, but it was amended to cover only employees who work for a department, office, division, agency, commission, board, committee, or other organizational unit of the state.

What Louisiana Election Results Mean for Employers

At first glance, nothing significant came out of Louisiana’s midterm elections. There were no Tea Party candidates to create excitement. Republicans and Democrats each lost a U.S. House seat and won a seat they hadn’t controlled, so we didn’t contribute to the change of control in the House. However, the Republican takeover of the House and the Democrats’ loss of their super-majority in the U.S. Senate will have a significant impact on the Democrats’ legislative agenda. As President Barack Obama said Tuesday morning, “My whole agenda is at risk.”

I predicted from the beginning that the Employee Free Choice Act (EFCA) would not survive a Republican filibuster even with a Democrat super-majority. After today, EFCA, the Paycheck Fairness Act, and any compromise measures are dead and buried; probably along with the rest of the administration’s labor and employment agenda.

Louisiana Governor Signs Firearms Law

Effective August 15, Louisiana will join a growing number of “red” states that have limited employer policies banning guns from the workplace. Under the new law (Senate Bill 51), employers may not prohibit employees from storing “lawfully possessed” firearms in their locked personally owned or leased vehicles while parked on company property.

The new law does not limit an employer’s right to prohibit employees from carrying firearms on their person while at work or on company property when outside of their personal vehicles or from carrying or storing firearms in company-owned or -leased vehicles provided to employees for their business and personal transportation. The new law also expressly allows employers to require that any firearms stored in employees’ personal vehicles be hidden from plain view or locked in a case or container within the vehicle.
