Trump proposes ‘substantial’ DOL budget cut

The U.S. Department of Labor (DOL) would see a nearly 21 percent reduction in funding under the White House’s proposed 2018 discretionary spending budget, which was released March 16.

“A 21 percent cut is very substantial,” according to H. Juanita Beecher, of counsel with Fortney & Scott in Washington, D.C., and an editor of Federal Employment Law Insider. It’s unclear, however, which DOL subagencies will be affected, she said.

Employers advised to stay up to date on legal trends affecting transgender rights

The Trump administration’s action rescinding guidance to public schools on restroom policies for transgender students sends a different signal than guidance from federal agencies dealing with employment, but the real message for employers is to stay tuned.

On February 22, the Trump administration revoked Obama administration guidelines that advised public schools to allow transgender students to use restrooms corresponding to their gender identity instead of their gender assigned at birth. The Trump administration’s new guidance now puts the question of restroom access on states and school districts.

Judge clears way for antiretaliation portion of new OSHA rule

The antiretaliation provisions of the Occupational Safety and Health Administration’s (OSHA) new electronic record-keeping rule are set to be implemented on December 1 after a Texas federal judge denied a request for a preliminary injunction on November 28.

The eventual fate of the rule isn’t known since Judge Sam Lindsay of the U.S. District Court for the Northern District of Texas said his decision to deny the preliminary injunction “is not a comment or indication” on who will ultimately prevail in a lawsuit challenging the rule. “This determination is left for another day,” he wrote in his opinion.

OSHA again delays enforcement of new record-keeping rule

The Occupational Safety and Health Administration (OSHA) has once again delayed enforcement of its new record-keeping rule that would, among other things, limit an employer’s ability to conduct postaccident drug and alcohol testing.

As first reported by McAfee Taft attorney Paige Hoster Good, OSHA agreed to delay enforcement of the rule until December 1, 2016. The rule had been scheduled to take effect on November 1, a date settled on after the rule was first scheduled to take effect on August 10.

Employers must meet new safety data requirement by June 1

Employers need to be ready for a new requirement from the Occupational Safety and Health Administration (OSHA) that changes the format of safety data related to chemicals in the workplace.

OSHA is replacing its material safety data sheet (MSDS) requirement with a more uniform document called the safety data sheet (SDS). The deadline for employers to comply is June 1.

Proposed rules on contractor ‘blacklisting’ order published

The controversial proposed “blacklisting” regulations implementing President Barack Obama’s Fair Pay and Safe Workplaces Executive Order have been published in the May 28 edition of the Federal Register for notice and comment. The proposed regulations were issued by the Federal Acquisition Regulation (FAR) Council.

The order, which the proposed regulations interpret, applies to prospective and existing contractors with contracts over $500,000. The order provides that employers can be denied federal contracts if they have violated or have allegedly violated a number of federal, state, or local labor and employment laws within the past three years.

New OSHA reporting requirement takes effect January 1

A new rule from the Occupational Safety and Health Administration (OSHA) requiring employers to notify the agency when an employee is killed on the job or suffers a work-related hospitalization, amputation, or loss of an eye goes into effect on January 1 for workplaces under OSHA’s jurisdiction. The rule also updates the list of employers that are partially exempt from OSHA’s record-keeping requirements.

The previous regulation required employers to report work-related fatalities and in-patient hospitalizations of three or more employees within eight hours of the event. Reporting single hospitalizations, amputations, or loss of an eye wasn’t required under the previous rule.

OSHA seeks more comments on injury and illness tracking

The federal Occupational Safety and Health Administration (OSHA) has extended the comment period for the proposed rule to improve tracking of workplace injuries and illnesses. Comments will be accepted through October 14.

The proposal, published on November 8, 2013, would amend the agency’s record-keeping regulation to add requirements for the electronic submission of injury and illness information that employers are already required to keep.

Training, enforcement key parts of DOL’s proposed budget

The Obama administration’s proposed U.S. Department of Labor (DOL) budget for fiscal year 2015 stresses a continuation of enforcement initiatives from previous years as well as new job training and assistance initiatives.

Released on March 4, the budget proposal includes $11.8 billion in discretionary funding for the DOL, $300,000 less than the request in the 2014 proposed budget. The 2015 proposal also includes new dedicated mandatory funds. A DOL statement says the proposed budget adheres to the spending levels agreed to in the Bipartisan Budget Act of 2013 and includes the fully paid-for Opportunity, Growth, and Security Initiative.
